The Abidal is a “data controller”. This means that we are responsible for deciding how we hold and use personal information about you.

  • we may also invite you to complete surveys that we use for research purposes, although you do not have to respond to them..

We may also collect, store and use the following “special categories” of more sensitive personal information:

Information about your race or ethnicity, religious beliefs, sexual orientation.

Information about your health, including but not limited to any medical conditions, food allergies.

IV How is your personal information collected?

We collect personal information about data subjects through various methods; check-ins, bookings, and reservations. Either directly from data subjects or sometimes from a third party acting on our behalf (for example through a booking agency, travel agent or corporate account).

V How we will use information about you

We will only use your personal information when the law allows us to. Subject to applicable laws, we may collect and use your personal information in the following ways:

  • to provide the services you request from Abidal;
  • to improve (or seek to improve) the services we provide to you and to enable us to provide you with a more personalised experience;
  • to communicate with you about our products and services of Abidal and
  • for internal marketing analysis, for example, to assess purchasing or viewing trends or to measure the amount of traffic to our websites; and
  • to improve the effectiveness of our website;
  • to carry out our obligations arising from any contracts entered into between you and us;

  • we may also use your data, or permit selected third parties in the hospitality sector and/or carefully selected marketing partners that are doing business with our hotels and/or our Abidal brand to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by email, post or telephone. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data.

We may also use your personal information in the following situations, which are likely to be rare:

  1. Where we need to protect your interests (or someone else’s interests).
  2. Where it is needed in the public interest or for official purposes or requested for by the police or governmental authorities.

 

VI If you fail to provide personal information

If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into with you (such as providing a benefit), or we may be prevented from complying with our legal obligations (such as to ensure the health and safety or proof of nationality for example passport)

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. IX Data sharing

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets for the purpose of effecting those transfers.
  • If Abidal or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions and other agreements; or to protect the rights, property, or safety of Abidal, our customers, or others.   • We may permit selected third parties in the hospitality sector to and/or carefully selected marketing partners that are doing business with our hotels and/or with our brand use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by email, post or telephone. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the form on which we collect your data;

From time to time, we may be required to disclose your personal information in accordance with applicable laws or if we are compelled to do so by a court of law or lawfully requested to do so by a governmental entity. We may also determine that it is necessary or desirable to do so in order to comply with the law or to protect or defend our rights or property.

All our third-party service providers and other entities in the group are required to take appropriate security measures to protect your personal information in line with our policies. We do not allow our third-party service providers to use your personal data for their own purposes.
